We assist employers in all matters related to the competences and tasks of the WoCo, CPPW and UD.
We are frequently consulted on the following issues:
- When should the works council be informed?
- What are the prerogatives of the trade union delegation compared to the works council and the CPPW?
- What are the rights of trade union delegates and employees’ representatives, in particular regarding trade union time?
We also regularly draft company agreements and company collective bargaining agreements (CBA). In this context, we draw your attention to the various aspects of the agreements concluded (conformity with sectoral provisions, social and fiscal treatment of remuneration conditions, validity of the agreement in time, non-incorporation in employment contracts, etc.).
We also assist companies in the strategic preparation and organisation of their social elections, including actions before the labour courts. We answer all questions arising in this context, such as:
- When should social elections be held? What are the applicable thresholds?
- What communication can be made by trade unions in the framework of social elections?
- How are the available mandates allocated among the trade unions?
- Who can or cannot be candidate for social elections?
